SHIPPING TERMS (GENERAL)
HomeBrewed Tech, LLC d/b/a Oznr (“Oznr”) provides the Oznr App (the “App”) as an electronic platform for the purpose of connecting consumers (“Buyer” or “you”) to retailers (each a “Partner”) who engage in the sale, fulfillment, transportation and/or shipping services for alcoholic beverages (“Products”) through the App.
The following general shipping terms apply to all transactions conducted through the App. The Partner may specify additional terms for any such transaction, and Partner’s additional terms shall control with respect to all transactions with such Partner.
All alcoholic beverage sales, fulfillment, transportation and shipping services conducted through the App are solely transacted between you and the applicable Partner(s) from the location of the applicable inventory to the shipping destination that you specify. It is the responsibility of the Partner and any shipping provider(s) that they use to verify your location, identification, and age, and to determine whether it is legal and otherwise safe and appropriate to sell and furnish you with alcoholic beverages
For the avoidance of doubt, Oznr does not make available, produce, provide, sell and/or resell alcoholic beverages or alcoholic beverage fulfillment, transportation, or shipping services, and is not a licensed alcoholic beverage transportation carrier or retailer. Oznr makes no representation as to any laws, rules, or regulations of any jurisdiction regarding the production, sale, fulfillment, transportation, and/or shipping of alcoholic beverages to any consumer, including you. YOU HEREBY ACKNOWLEDGE AND AGREE THAT OZNR IS NOT ENGAGED IN OR RESPONSIBLE FOR THE PRODUCTION, SALE, FULFILLMENT, TRANSPORTATION, AND/OR SHIPPING OF ALCOHOLIC BEVERAGES.
Partners cannot ship to zip codes that have enacted local option to exclude the sale or shipment of alcoholic beverages. By purchasing Products, you verify that you have checked your local laws and have confirmed that importation of alcoholic beverages is permitted. Partners cannot ship to PO Boxes, APO/FPO addresses, Mail Boxes, or internationally.
As Products contain alcohol, Partners are required to ship with Adult Signature Required, which means you will be required to show your ID to the delivery driver prior to taking delivery. Adult Signature Required shipments require an additional surcharge which will be passed on to Buyer. In the interest of avoiding missing deliveries, you should consider using your place of work as the delivery location. You may also opt to pick up your package at a shipping facility near you. If the recipient is found to be under the age of 21 by the shipping company, the order will be returned and no refund will be given.
If your package of Products is returned to a Partner, the Partner may re-ship it to you for additional shipping charges. Oznr will not refund any shipping and packaging charges..
In addition to the Adult Signature requirement, Partners are required to ship all alcohol Products in approved shipping containers to ensure they are handled properly. All shipping package costs will be added to your total at checkout.
The title to Products is passed from the seller of the Products to the Buyer at the time of the sale and the Buyer remains responsible for shipping costs, including insurance. Oznr makes no representation to the legal rights of anyone to ship or import beverages containing alcohol. You authorize Partners to act on your behalf to coordinate fulfillment of your order to you.
Partner is not liable for damages to Products caused by weather conditions and/or “Acts of God” during transportation. “Acts of God” include catastrophes such as, but not limited to, plane crashes, unforeseeable delays or accidents, destruction due to domestic and international unrest (i.e. riots, war, public enemies) confiscation, quarantine, or natural disaster.
Price and availability of Products are subject to change by Partner without notice. Once your payment is confirmed, Partners will make every effort to ship your order within 5 business days. Some orders may take a little longer during peak seasons. If you place an order and an item is out of stock, Partner will contact you and ask you if you would like a refund or if you would like to wait until Partner receives the Products. Partners retain the right to refuse any order.
